Application (“NDA”); (3) as a result of the manufacturing deficiencies,
Nabriva’s NDA for CONTEPO was unlikely to be approved by the FDA; and
(4) as a result, Nabriva’s public statements were materially false and
misleading at all relevant times. When the true details entered the
market, the lawsuit claims that investors suffered damages.
